HOUSTON EXPUNCTION ATTORNEY

If you were ever arrested for a crime in Houston, or a surrounding area, a simple criminal background check will quickly uncover this information. Background checks of your criminal record often occur when you apply for a job, mortgage, loan, financial aid, or even to lease an apartment. Most colleges and graduate programs also require that you divulge this information. Texas permits you to completely clear your arrest record in certain circumstances through a process known as “expunction” or "expungement." The Law Office of Nicholas R. Westbrook can assist you with this important (and sometimes necessary) legal process. I offer affordable rates and want to help.

To determine whether you qualify for an expunction, please call the Law Office of Nicholas R. Westbrook at (713) 936-2174. You may also contact me directly through email or our Free Case Evaluation. I would be happy to meet with you, explain the expunction process, and discuss whether you qualify under the law.

CLEARING YOUR CRIMINAL RECORD THROUGH EXPUNCTION –

Expunging your criminal record in Texas is a difficult and time-sensitive process that only applies to certain defendants. An expunction guarantees that your criminal history will be hidden from all background checks performed by credit bureaus, lenders, credit card companies, employers and universities who might otherwise deny you benefits or services because of your past. The whole process takes up to three months to complete. You may be eligible to clear your criminal record through an expunction if you satisfy one of the following criteria:

  • You were found “Not-Guilty” after trial.
  • You were arrested but never formally charged with a misdemeanor information or felony indictment; the charge is no longer pending for any reason; and you have not been convicted of a felony in the five (5) years preceding the date of the arrest to be expunged.
  • You were charged with a misdemeanor information or felony indictment, but the Court dismissed your charge and/or quashed the information or indictment; the statute of limitations for your charge has run; and you have not been convicted of a felony in the five years preceding the date of the arrest to be expunged.
  • You were convicted but later pardoned by the Governor (good luck on this one).
  • You were convicted at the trial level but then acquitted by the Texas Court of Criminal Appeals.
  • Another person pretended to be you when they were arrested, leading to false charges on your record.

EFFECT OF EXPUNGING YOUR CRIMINAL RECORD –

If you are eligible for an expunction, according to one of the criteria listed above, our Houston expunction lawyer can help. As a dedicated and knowledgeablee expunction attorney in Houston, I will prepare the necessary Petition for Expunction and successfully argue your case to the Judge. If your expunction is granted, criminal justice agencies will be prohibited from releasing your criminal record. Some government entities and law enforcement agencies will continue to have access to your criminal history, such as the FBI and CIA. Nevertheless, your criminal record will vanish from background checks and ultimately be cleared.

The best part of an expunction is your ability to deny the existence of your arrest, and even the expunction process, unless you are questioned about the expunction in a subsequent criminal proceeding.
