PUNISHMENT RANGE FOR FELONIES IN TEXAS –
Common penalties for a felony crime include probation, excessive fines, community service, state jail or prison time, restitution, counseling or treatment, and a serious mark on your permanent criminal record. Texas provides the following range of punishment for felony offenses:
State Jail Felony – If you are convicted of a State Jail felony, the punishment range is from 180 days to 2 years in a state jail facility and a fine up to $10,000. Unlike county jail and prison, you will not receive any credit for time served in a state jail facility, meaning you will serve day for day. To avoid this enhanced punishment, it is in your best interest to contact Nicholas R. Westbrook, a Houston felony defense lawyer, immediately. I will help you avoid state jail time and obtain a successful resolution to your criminal matter.
Third-Degree Felony – If you are convicted of a Third-Degree felony, the punishment range increases from two (2) to ten (10) years in prison and up to a $10,000 fine.
Second-Degree Felony – If you are convicted of a Second-Degree felony, you will face an enhanced punishment from two (2) to twenty (20) years in prison and up to a $10,000 fine.
First-Degree Felony – If you are convicted of a First-Degree felony, the punishment is more severe, including a term in prison from 5 to 99 years and a fine up to $10,000. The term may also include confinement in prison for life.
Capital Felony – Capital felonies are the most heinous of all crimes, including capital murder and aggravated sexual assault with enhancing facts. A conviction for one of these crimes will either be life in prison or death.
