If you have been accused of committing a sex crime in Texas, your rights and future are in serious danger. Of all the offenses in Texas, sex crimes are generally considered the most heinous and immoral. Because of this, the State will prosecute you with extreme ferocity and resolve, and will usually seek the harshest of penalties. The mere accusation of a sex offense can cause your family, friends and co-workers to distance themselves from you. The community may begin treating you differently, and a conviction for certain sex crimes could result in a permanent label of “sex offender”. You have worked too hard for too long to let an accusation and potential conviction destroy your life.

To discuss your case with an experienced Houston criminal defense lawyer, please call the Westbrook Law Firm, PLLC at (832) 767-0052. You may also contact me directly through email or the Free Case Evaluation. I would be happy to meet with you, explain the criminal charges filed against you, and discuss your options moving forward.

There are numerous criminal offenses that qualify as a "sex crime". Some sex crimes involve unlawful acts that are sexual in nature and committed without the other person’s consent. Other sex crimes are more victimless, but are considered criminal in nature due to the supposed immorality associated with such offenses. Due to the complexity of most sex crimes, my office limits representation to the following offenses:

  • Prostitution
  • Promotion of Prostitution
  • Sexually Oriented Business Violations
  • Public Lewdness
  • Indecent Exposure

Over the past several years, I have seen an increase in the number of arrests and criminal charges for Prostitution and Sexually Oriented Business Violations. If you have been accused of either of these sex crimes, please contact the Westbrook Law Firm, PLLC as soon as possible.

Prostitution – Charges for prostitution typically develop through undercover sting operations. Vice officers pretend to be potential clients or prostitutes, and try to trap citizens into committing this offense. As a Houston prostitution defense attorney, I am fully aware of these undercover investigations and have the experience to successfully defend this criminal charge. I have helped numerous clients charged with the alleged act of prostitution, as well as the alleged act of solicitation. In either situation, there are specific elements the State must prove to obtain a conviction. On many occasions, the vice officers fail to gather the necessary evidence to support these elements, leading to dismissals and acquittals of all charges. To have any chance at a conviction, the State must prove you knowingly: (1) offered to engage, agreed to engage, or engaged in “sexual conduct” for a fee; or (2) solicited another in a public place to engage with that person in “sexual conduct” for hire. “Sexual conduct” includes deviate sexual intercourse, sexual contact, and sexual intercourse. Oddly, this statute does not require any intent to fulfill the sexual act, just an agreement. If the State fails to prove an agreement was reached, your charges could be dismissed. If you have been arrested for prostitution due to a sting operation or otherwise, please contact me today.

Sexually Oriented Business Violations – In many cities, including Houston, there are ordinances and local laws prohibiting certain activity in sexually oriented businesses, such as topless dance clubs. Houston imposes a “three foot rule,” which specifically prohibits any topless or nude dancer to get within three (3) feet of a customer. Most dancers ignore this rule, choosing to perform lap dances for their customers. Vice officers are aware of this illegal activity and regularly target popular strip clubs around town. If you have been arrested and accused of a violation of the 3 foot rule or other sexually oriented business violation, please call my office today. I have helped numerous clients with this criminal charge, including reduced criminal charges and dismissals.

The consequences of a sex crime conviction could be detrimental to your reputation and life, depending on the severity of the crime. If you are convicted of these charges, you will be subjected to a number of life-altering penalties, such as jail time, potential prison time, steep fines, mandatory counseling, and a mark on your permanent record. You may also have to register as a “sex offender”, which could affect your career, where you live and your livelihood. Being labeled a “sex offender” is a serious penalty, as your information will be posted on a web site that is available for anyone to view. You will also be required to tell future employers of your criminal conviction, which could severely limit your future employment opportunities. You need the experience and relentless defense of Nicholas R. Westbrook to assist you. Call me today.
